Property Regulations

§ 1. INTRODUCTION

This regulation defines the terms of stay at the Osada Kościelisko Apartments in Kościelisko at ul. Kierpcówka 34 A-J, postal code 34-511, phone number: 660 719 300, as well as the provision of apartment rental services for residential purposes.

  1. The manager of the apartments is the company Doxa ZN Sp. z o.o. with its registered office at Al. Jerozolimskie 65/79, 00-697 Warsaw, NIP: 5272826633, KRS: 0000703124, registered in the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, share capital: 5,000.00 PLN, hereinafter referred to as the Lessor.

  2. As the Lessor and the Hosts of the Estate, we highly appreciate your cooperation in complying with these regulations, which are intended to ensure a peaceful and safe stay for Guests.

  3. We will make every effort on our part to make your stay pleasant and safe.

  4. We kindly ask Guests to behave as they would like others to behave towards them.

§ 2. APARTMENT RENTAL SERVICE

  1. The rental price includes all taxes and additional fees, i.e., fees for utilities such as electricity, water, Internet, TV, and cleaning before the Guest's arrival.

  2. The apartment is equipped with bed linen and towels.

  3. For stays up to and including 7 days, additional bed linen and towel changes during the stay are possible for an extra fee. Please check the additional services price list at the end of the regulations for the fee amount.

  4. For stays longer than 7 days, the Guest has the right to request a towel and bed linen change once a week free of charge. Please notify the Estate Hosts of your desire to exchange.

  5. For 4-person apartments, one parking space is provided, and for 6 and 8-person apartments, two parking spaces are provided. In case of arrival with more cars than mentioned above, Guests may be asked to park outside the Estate. In case of heavy snowfall, the number of parking spaces may be reduced. For all parking organization matters, please contact the Estate Hosts.

  6. Parkings are not supervised, so we do not bear responsibility for damage or loss of the vehicle or other vehicle belonging to the Guest.

  7. The Guest may bring a pet to the apartment. The Lessor charges an additional fee for this service. Please check the additional services price list at the end of the regulations for the fee amount. In the interest of hygiene, pets are not allowed in areas where meals are consumed, children's playgrounds, and other designated areas on our premises. Pets on the Estate must be leashed, and the Guest is obligated to clean up all waste after their pet. Bringing the animal's bed is required. Animals are prohibited from being on beds, sofas/couches, and armchairs. When the Guest is absent from the apartment, the pet must be left in a cage. Leaving the pet alone is only allowed if it does not disturb the peace of the Estate.

  8. We reserve the right to refuse acceptance of a Guest’s pet stay if the pet is assessed by us as potentially dangerous or likely to disturb order or peace in our Estate.

  9. We can also provide an additional folding bed in the Apartment. Due to a limited number of beds, please contact the Estate Hosts to check availability. Please check the additional services price list at the end of the regulations for the fee amount.

  10. As the Lessor, we commit to promptly respond to comments and complaints regarding the service level, operation of equipment, and cleanliness and order in the Apartment by taking actions aimed at immediately removing defects or deficiencies.

  11. As the Lessor, we are responsible for the quality of the services provided in the manner prescribed by universally applicable law.

  12. As the Lessor, we are not responsible for the Guest's personal belongings left or stolen from the Apartment in case of burglary.

  13. If items belonging to the Guest are found in the Apartment after departure, they may, upon explicit request, be sent to a specified address. Shipping costs are borne by the recipient.

  14. Each apartment has a water heater that heats water. Please use hot water sparingly. If hot water runs out, just wait a few minutes for the boiler to heat the water again.

§ 3. GUEST'S OBLIGATIONS

  1. The Guest agrees to use the rented object - the Apartment - solely for residential purposes and may not sublease or lend the Apartment to third parties free of charge.

  2. The number of persons staying in the Apartment is limited to the number reported during the reservation process. Each Apartment also has a maximum number of Guests allowed. We can add a maximum of one extra bed to the apartments. The Lessor may consent to a greater number of guests than the apartment's maximum for an additional fee. Please check the additional services price list at the end of the regulations for the fee amount.

  3. The Guest is obliged to respect the principles of good neighborliness. If the Guest significantly disturbs the peace or the property of neighbors and does not comply with commonly applied social norms and these regulations, the Lessor reserves the right to terminate the contract without notice and is not then obliged to refund the Guest for the unused period of stay (contractual penalty).

  4. The Guest is obliged to keep the Apartment in the condition in which it was at the start of the stay. Moving furniture and household appliances/electronics provided in the Apartment is prohibited.

  5. We ask Guests to sort waste according to the instructions on the containers located in each apartment's kitchen, in the garage containers, and according to recommendations given by the Host.

  6. Quiet hours are in effect throughout the Estate and all Apartments from 11:00 PM to 7:00 AM. In case of persistent and gross violation of this rule, §3 point 3 of these regulations will apply.

  7. The Guest is financially responsible for any damage or destruction to the equipped items and technical devices caused by the Guest or persons staying in the rented Apartment during the rental agreement period. The Guest is financially responsible for damages and may not replace broken items themselves. Parents are responsible for any damage caused by children. The Guest is also responsible for any damage caused by their pet(s).
    We reserve the right to charge Guests for any damage beyond normal wear and tear and for any extended cleaning required. At check-in, the Lessor may request a deposit of 500 PLN in case of possible damages. The deposit is refunded after apartment inspection within 2 days of check-out.

  8. Please remember that we are not responsible for the safety of children playing on the premises. Note that some places, especially slopes, electrical installation cabinets, septic tank and sewage system inspections, and other technical equipment on the Estate may be dangerous for children.

  9. Please observe the ban on entering slopes on the Estate premises.

  10. The Guest is responsible for the Apartment keys. Losing the keys results in a fee as specified in the additional services price list at the end of the regulations.

  11. Due to fire regulations and primarily for the safety and comfort of Guests, smoking and using open flames, including lighting grill devices, inside the Apartment is strictly prohibited! Violation of the smoking ban obliges the Guest to pay a contractual penalty of 500 PLN.

  12. The Lessor has the right to refuse admission to a Guest who grossly violated these regulations, caused damage to the Lessor's property, or disturbed good neighborly relations during a previous stay.

  13. Organizing any parties (bachelor, bachelorette, and similar) in the Apartment without the Host's consent is prohibited. Violation of this ban will result in application of § 3 point 3 of these regulations.

§ 4. ARRIVAL, KEY COLLECTION AND PAYMENT

  1. The hotel day starts at 4:00 PM and ends at 10:00 AM the following day.

  2. Check-in takes place from 4:00 PM to 10:00 PM. Late check-in, i.e., after 10:00 PM, is possible upon prior phone contact to confirm the possibility. We reserve the right to charge the Guest an additional fee for this service as specified in the additional services price list at the end of the regulations.

  3. If you cannot arrive at the agreed time, the Guest is obliged to immediately notify the Host by phone.

  4. During the handover of the apartment, the Guest is required to present ID and confirmation of a paid reservation. Keys to the apartment will be handed over by the Host or a person authorized by him.

  5. Payment for the stay is made in advance on the day of arrival unless made earlier.

  6. If the reservation was confirmed by deposit, the Guest is asked to pay the remainder of the amount before check-in. The Lessor accepts cash payments or payments by Visa, Visa Electron, MasterCard, and Maestro debit or credit cards. Payment can also be made by bank transfer.

§ 5. PERSONAL DATA PROCESSING

  1. The Lessor is the data controller within the meaning of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR).

  2. The Lessor's contact details are contact details related to the processing of Guests' personal data.

  3. The processing of Guests' personal data may include data such as: first and last name (including sole proprietorship name), home address, PESEL number, ID number, e-mail address, phone number, information about the date and time of the telephone call and the call's duration and status (missed, received), IP address, preferred date and time of service, data related to the bank account from which the transfer was made, credit card or other payment forms where personal data is processed, vehicle registration number, data of other guests including children and their age. In case of credit card hold due to securing claims related to possible Apartment damage, data such as the cardholder's name, card number, expiration date, and CVV code may be stored.

  4. To enable the Lessor to conclude and perform the contract, the Guest is obliged to provide personal data such as: first and last name, e-mail address, phone number, payment data, as well as data related to other guests including children and their age. Providing data is a condition for concluding the contract.

  5. Moreover, the purpose of processing Guests' personal data includes: pursuing or defending legal claims, documenting service provision for tax purposes, ensuring the highest quality of services for Guests, ensuring Guest safety, preventing damage to the Controller or Guest.

  6. If data are processed based on the Controller's legitimate interest, including marketing its own services, the Guest has the right to object to such processing at any time.

  7. If personal data is processed based on Guest consent, the consent may be withdrawn at any time.

  8. Personal data may be shared with the following categories of recipients: companies providing IT support and software, accounting firms, shareholders for reporting and support, transport and taxi companies when transport or courier shipments are ordered by the Guest, companies organizing events or optional activities on behalf of the Guest. Data may also be disclosed to other recipients for purposes arising from the legitimate interests of the controller or a third party.

  9. Data will be processed for the period necessary to achieve the processing purposes, i.e., until completion of contract performance, and thereafter for the period required by law or for the realization of possible claims.

  10. Guests have the right to request access to their personal data, rectification, restriction of processing, deletion, or data portability.

  11. In case of belief that processing of personal data violates GDPR provisions, a complaint may be lodged with the supervisory authority, i.e., the President of the Personal Data Protection Office.

  12. Providing personal data is voluntary but failure to provide data may result in the inability to provide rental services.

§ 6. COMPLAINTS

  1. In case of irregularities, the Guest has the right to file a complaint (including those related to electronic reservation services) within 14 days of their occurrence. Complaints, grievances, and any other notifications should be sent to biuro@osadakoscielisko.pl.

  2. Complaints will be processed within 14 working days of receipt. The Guest will be promptly notified by e-mail about the outcome.

§ 7. FINAL PROVISIONS

In case of disputes arising from activities not covered by these regulations, the provisions of the Polish Civil Code shall apply.

Within the scope permitted by mandatory laws, contracts are governed by Polish law.


Price list of additional services

  1. Change of bed linen and towels during stays up to and including 7 days

Per person – 30 PLN.

2. Pet stay in the apartment

  • Per day, per animal – 60 PLN.

  1. Extra bed in the apartment per day:

  • off-season – 100 PLN,

  • during Christmas – 150 PLN,

  • during New Year – 200 PLN.

  1. Lost apartment keys – 300 PLN.

  2. Arrival and check-in after 10 PM – 50 PLN per hour

  3. Breaking or destroying the terrace handle – 500 PLN.

  4. Extension of the hotel day (subject to availability) – 50 PLN per hour

  5. Baby cot – 50 PLN per day
